The motion to suppress cites independent testing from Forensic Analytics in California, alleging multiple contributors and possible tampering.

Geragos said, "This is not a single-shooter slam dunk," but he offers no explanation for how his client ended up with the weapons or why every other piece of evidence screams guilt.

Robinson was arrested within hours of the shooting, with eyewitnesses placing him on the rooftop, security footage capturing his approach, and his own social media history showing an obsession with Kirk.

Social media lit up on February 5, 2026, after Geragos posted the motion on X, with left-wing accounts hailing it as "proof of a setup." Conservative voices like Tucker Carlson called it out on his February 6 show as "defense desperation in a cut-and-dry case." The prosecution dismissed the motion as "baseless tactics" in a February 6 statement, noting their own tests confirm Robinson's DNA as the primary match.
